
Sec. 1501.009 of the TEXAS INSURANCE CODE stipulates an independent school district may elect to participate as a small employer without regard to the number of employees in the district. Is it a Dead Letter statute?
The answer is yes. Texas school districts can no longer be considered small group.
Sec. 1501.009 of the TEXAS INSURANCE CODE has been superseded by Texas Education Code Section 22.004 which imposes requirements that small‑group plans cannot meet. Carriers will not provide small group quotes to school districts.
