Paxton Accuses Drug Manufacturer of Bribing Providers in Texas

AUSTIN (KXAN) — On Tuesday, Attorney General Ken Paxton said he filed a lawsuit against Eli Lilly, a pharmaceutical company headquartered in Indiana.

According to the AG’s office, Eli Lilly was accused of “bribing and illegally inducing medical providers to prescribe its most profitable drugs.”

KXAN reached out to Eli Lilly for a statement. A spokesperson with the company provided the following.

“Multiple courts and the federal government have rejected claims by this same corporate relator against Lilly as meritless,” the spokesperson said.

In a prior case, Eli Lilly claimed the government determined the allegations lacked sufficient factual and legal support.

“We intend to vigorously defend against these allegations,” the spokesperson said.

The AG’s office said Eli Lilly offered illegal incentives to medical providers in Texas in an attempt to enhance profits. The listed incentives included “free nurses” and reimbursement support services.

“These inducements were designed to steer providers toward prescribing Eli Lilly’s drugs,” the AG’s office said. “In many cases, these prescriptions were covered by Medicaid, resulting in millions of dollars in claims to Texas Medicaid that were tainted by Eli Lilly’s illegal marketing and quid pro quo arrangements, in violation of the Texas Health Care Program Fraud Prevention Act.”
