An important decision for reference base pricing (RBP) was issued today in Utah. In short: the case is moving forward and was not entirely dismissed. However, both parties achieved victories and losses in this 24 page decision related to the numerous claims.
This is a suit where the hospital alleged numerous claims against the RBP vendor and the RBP vendor responded with a motion to dismiss. The motion to dismiss was granted on all of the claims except for the tortious interference with contract claim and the permanent injunction claim related to those business practices.
It is important to note that this is still an early stage in the case and the fact the allegations survived dismissal does not mean they are true, but only that the case moves forward. The decision deserves (and will receive in time) a lot more written analysis than this paragraph, but this is a start
